BELOW ARE THE TERMS AND CONDITIONS THAT HAVE BEEN WRITTEN AND IS THERE TO PROTECT YOU (THE CLIENT/CUSTOMER) AND MYSELF (SAMS DESIGNS). IT IS RECOMMENDED THAT YOU REVIEW THESE TERMS PRIOR TO PURCHASING OR CONTACTING ME FOR PROJECTS.
SDS Creative™ — Terms of Service
By purchasing digital products from SDS Creative™, you agree to the following terms:
Digital Products
All products sold through SDS Creative™ are digital downloads unless otherwise stated.
No physical item will be shipped.
Usage
Products may be used for:
- personal projects
- branding inspiration
- content creation
- client projects
- creative workflows
Restrictions
You may not:
- resell SDS Creative™ products
- redistribute files
- upload products to resale websites
- claim SDS Creative™ products as your own work
- share purchased files publicly or privately
Intellectual Property
All products, graphics, layouts, branding, and resources remain the intellectual property of SDS Creative™.
Services
REFUNDS + CANCELLATIONS
Sams Designs does not provide refunds for any services unless agreed upon. Having buyers remorse or wanting to use another company instead is not a suitable means for a refund. Once projects have been begun, a refund will not be provided if the client chooses to no longer want the services. Once payment has been made to Sams Designs, the project will begin in the time frame given to the client. It is advised that you give the project ample time for completion for these reasons: revisions may be needed, it may be a peak in the orders received and prior work received may take longer than expected. I will provide a suitable time frame, however, there may be an additional business day or two needed before I can begin if it is a busy time. Refunds will also not be given if the client does not want the service after using revisions, you will receive a order cancellation email with no refund.
Failing to respond to Sams Designs in a orderly time frame of 48 hours regarding emailed information for designs will result in a cancellation of your entire order with no refund. If for any reason the client runs into personal issues with banking or credit/debit cards please do not hesitate to let Sams Designs know before any steps are made. Failure to inform Sams Designs of these issues prior to a refund/cancellation will result in loss of funds and Sams Designs will not be held accountable.
The only reason refunds will be provided is in the event Sams Designs is unable to complete the project for personal reasons or illness, not if Sams Designs emails to let the client know of an order extension and the client will still receive order.
REVISIONS
For most projects done by Sams Designs, there is a (3) revision limit. After that, all additional revisions will result in a $10 fee per revision. For bundle packages, the number of revisions is limited to 2. This is to ensure a steady work flow so your project can be completed in a reasonable time frame.
DESIGN CONCEPT
It is important to have a vision of some kind for your business so it can be relayed to Sams Designs. If you would like for me to freestyle my ideas for your project, keep in mind that our visions might not match what you would like for your brand. This can lead to more revisions if needed. It is best to have even a small concept when it comes to the service you are purchasing. Clients are required to submit all HIGH QUALITY photos and/or text that they need for their project. Pixelated photos will not result in the best quality design. Please refrain from sending low quality phone images. Make sure all images are not subject to copyright. All revisions on my end will be communicated first.
You (the client) will receive logo drafts during the process. You will be emailed 2-3 different logo designs and you are subject to choose 1 of these logos drafts and then make your desired revisions. All drafts sent to the client are the sole property of Sams Designs. Draft images of ANY kind are for the purpose of approval only. They may not be copied, manipulated, or distributed to any other person or company other than those directly involved with the project without prior permission from Sams Designs. If the client does not answer with revisions within 48 hours of being notified with a final notice of your drafts being sent. The entire order will be canceled, and you will not be able to receive a refund. A cancellation email will be sent to the email on file.
PROJECT TURN AROUND
It is extremely important for Sams Designs to complete projects in a timely manner. However, due to the uniqueness of each project and client, more time may be needed to get a satisfied completion. Please be advised that this relates to business days only. During peak/busy times, there may be an extension in the design timeframe of 1-3 business days. Weekends and major holidays are not included in the time frame of any project. All project previews should be given to the client via email within 7-14 business days. If the client approves the project sooner than this time frame the client will receive their project before this time frame is up.
FILE DELIVERY POLICY
All design only projects are sent to you (Client/Customer) in the from of email from me (Sams Designs). Logo designs will always be sent in JPG and/or PNG. Other digital projects (flyers, business cards, etc.) are sent in JPG or PNG format. If a PDF file is needed, Sams Designs will need to be contacted to supply that for you. Once a project has been finalized and the files have been delivered to you, you own the rights to what you have purchased. Copyrighting and/or trademarking your logo is solely up to you and is not the responsibility of Sams Designs.
After final designs have been sent via email, no other revisions are to be made for free. There will be a $15 per revision fee in place once the client decides they want revisions after all files have been sent. No refunds will be given due to this issue if the client decides to no longer want the service.
Sams Designs is not responsible for keeping up with your logo files, once 30 days is up, Sams Designs will remove files from our work computer. The client will be responsible for keeping up with all files. Files are sent via email.
Once completed, you (the client) also give Sams Designs the right to use for portfolio and/or marketing purposes unless agreed upon otherwise.
Product Updates
Products may be updated, improved, or expanded over time without notice.
